Beon Rewards Terms & Conditions
Effective as of June 1, 2023
Please review these Program Terms carefully. By enrolling and participating in the Program, you agree to these Program Terms as they may be updated from time to time.
1. Eligibility
(a) Carriers
The Program is open only to carriers with a Beon Carrier Portal account (collectively, “Carriers”), however, LTL (less-than-truckload) and Parcel carriers are not eligible to participate in the Program.
(b) Drivers
The Program is open only to individuals residing in the 50 United States, the District of Columbia (excluding Puerto Rico, U.S. Virgin Islands, and all other territories and possessions), and Canada who are at least eighteen (18) years of age or the age of majority in their jurisdiction of residence (19+ in AL & NE; 21+ in MS), have a valid U.S. commercial driver’s license, and who drive for a participating Carrier (collectively, “Drivers”).
2. Enrollment
Carriers and Drivers can enroll in the Program through the Beon Carrier Portal or Beon Carrier App. Individual drivers who wish to participate in the Program but work for a carrier who is not enrolled are encouraged to refer their carrier to the Program to be eligible to participate as a Driver. Upon successful enrollment, Drivers will be assigned a unique Beon Rewards identifier to allow Drivers’ participation in the Program to be tracked regardless for which Carrier a Driver works.
3. Program Description
The Program provides Carriers and Drivers the opportunity to earn Points (as defined below) by completing Actions (as defined below) as well as access to one or more Benefits (as defined below), based on a Carrier’s or Driver’s Tier (as defined below). The Program will be in effect from January 1 through December 31 of each calendar year (each such year, a “Program Period”).
(a) Tier
A Carrier’s total Beon digital load count in the immediately preceding Program Year will determine its Program tier (“Tier”) for the current Program Year, as described more fully in Table 1 below. Within a given Program Year, a Carrier can move up Tiers if its number of cumulative Beon digital load counts in that Program Year qualifies for a higher Tier.
(b) Points
Carriers and Drivers earn points (“Points”) by running digital loads with Beon and by performing other tasks as Beon may set forth from time to time (for example, by sending proof of delivery to Beon) (collectively, “Actions”). Carriers and Drivers must be enrolled in the Program to earn Points. Beon will not retroactively grant a Carrier or Driver any Points for Actions completed during a Program Year prior to the Carrier or Driver enrolling in the Program. If at any time during a Program Year a Driver works for a carrier who is not enrolled in the Program, none of the Driver’s work for such carrier will qualify for the Program or earn Points. The number of Points earned for a completed Action is based on the Carrier’s Tier, as described more fully in Table 1 below. Beon reserves the right to cap the number of Points a Carrier or Driver can earn.
Points can be redeemed using a third-party platform, Brandmovers, Inc. (“Redemption Platform”). Any use of the Redemption Platform is subject to the Redemption Platform’s terms of use, privacy policy, and/or end user license agreement (collectively, “Redemption Platform Terms”). By accessing and redeeming Points through the Redemption Platform, Carriers and Drivers agree to the Redemption Platform Terms.
Points do not expire unless a Carrier fails to complete the minimum number of annual digital loads listed in Table 1 below during a given Program Year. If a Carrier fails to meet the minimum annual digital load amount in a given Program Year, all Points earned will expire and cannot be redeemed. Driver points do not expire.
(c) Benefits
The Program may from time to time offer additional benefits (“Benefits”) to Carriers and/or Drivers. Benefits may include, for example, discounts on service or access to third-party platforms. When a Benefit provides access to a third-party platform (a “Third-Party Benefit”), Beon and the Third-Party Benefit provider may share certain data with each other to help improve Program participants’ experience with Beon. By using a Third-Party Benefit, Carriers and Drivers agree to the applicable Third-Party Benefit provider’s terms of use, privacy policy, and/or end user license agreement and the sharing of data with Beon.

4. LIMITATION OF LIABILITY & DISCLAIMER
IN NO EVENT WILL BEON, ITS SUBSIDIARIES AND AFFILIATES, AND EACH OF THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, EXEMPLARY, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, WHETHER BASED IN CONTRACT, TORT OR OTHERWISE, WHICH ARISE OUT OF OR ARE IN ANY WAY CONNECTED WITH THE PROGRAM, THESE PROGRAM TERMS, OR BEON’S OPERATION OF THE PROGRAM.
WITHOUT LIMITING THE FOREGOING, EVERYTHING REGARDING THE PROGRAM, INCLUDING THE BEON WEBSITE, ANY PROGRAM-SPECIFIC WEBSITE(S) OR APPLICATION(S), STATUS, POINTS, THE REDEMPTION PLATFORM, BENEFITS (INCLUDING THIRD-PARTY BENEFITS), AND ITEMS REDEEMED WITH POINTS, ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSIONS OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY. CHECK LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.
Beon makes no warranty that the Program, the Beon website, and any Program-specific website(s) and application(s) will be uninterrupted, timely, secure, or error free. Beon is not responsible for: (a) any loss or misdirection of, or delay in receiving, any enrollment application, correspondence, Status, Points, Benefits, or Points redemption requests; (b) theft or unauthorized redemption of Points; (c) any acts or omissions of third parties; or (d) any errors published in relation to the Program, including, without limitation, any typographical errors, errors of description, and errors in the determination of Status, Points, or Benefits. Beon reserves the right to correct, without notice, any errors.
5. Modification and Termination
Beon reserves the right, in its sole discretion, to modify, suspend, or terminate the Program and/or any part thereof, including without limitation any Benefits offered, at any time and for any reason, without any compensation to Program participants. Beon cannot and does not guarantee that all participants will be notified of such changes to the Program. Beon not issue you any Status, Points or Benefits, and you will forfeit all Status, Points or Benefits accrued, if Beon (a) suspends or terminates your participation because of conduct that Beon determines, in its sole discretion, violates these Program Terms or any applicable law, involves fraud, attempted fraud, or misuse of Program participation, or is harmful to the interests of Beon or its customers; or (b) modifies, suspends, or terminates the Program. Beon also reserves the right to deny future enrollment if Beon deems your conduct to have violated these Program Terms. Beon’s failure to insist upon or enforce your strict compliance with these Program Terms will not constitute a waiver of any of Beon’s rights.
Unless Beon suspends or terminates the Program, participation in the Program is for an indefinite duration. Carriers and Drivers can request to terminate their participation in the Program by emailing [email protected].
6. Updates to Program Terms
These Program Terms shall govern the Program as it applies to you from time-to-time. AS THE PROGRAM EVOLVES, THE TERMS AND CONDITIONS UNDER WHICH BEON OFFERS THE PROGRAM MAY BE MODIFIED AND BEON MAY CEASE OFFERING THE PROGRAM UNDER THE PROGRAM TERMS FOR WHICH THEY WERE PREVIOUSLY OFFERED. YOU UNDERSTAND AND AGREE THAT EACH TIME YOU USE THE PROGRAM, YOU ARE ENTERING INTO A NEW AGREEMENT WITH BEON ON THE THEN-APPLICABLE TERMS AND CONDITIONS AND YOU AGREE THAT BEON MAY NOTIFY YOU OF NEW TERMS BY POSTING THEM ON THE BEON WEBSITE (OR IN ANY OTHER REASONABLE MANNER OF NOTICE WHICH BEON ELECTS), AND THAT YOUR CONTINUED PROGRAM PARTICIPATION AFTER SUCH NOTICE CONSTITUTES YOUR GOING FORWARD AGREEMENT TO THE NEW TERMS FOR YOUR NEW USE. Therefore, you should review the posted Program Terms each time you use the Program. Any new Program Terms will be effective as of the time that we post them, or such later date as may be specified in them or in other notice to you. However, the Program Terms that applied when you previously transacted will continue to apply to such prior transactions (i.e., changes and additions are prospective only) unless mutually agreed. In the event any notice to you of new, revised or additional terms is determined by a tribunal to be insufficient, the prior agreement shall continue until sufficient notice to establish a new agreement occurs. In the event any tribunal finds any changed terms to be invalid, unenforceable or illegal, such will be severed to the extent necessary for the remainder to be valid and enforceable. You should frequently check the Beon website and the e-mail associated with your Program participation for notices, both of which you agree are reasonable manners of providing you notice. You can reject any new, revised or additional terms by terminating your Program participation as set forth in Section 5 and continued participation constitutes acceptance.
